Ante el Alcalde Mayor de Jalacingo, el defensor en nombre de su parte, presentó por testigo a Martín Acatzin, indio natural de Jalacingo, del cual se recibió juramento y siendo preguntado por el tenor de esta petición, dijo que al tiempo y cuando sucedió la muerte de Miguel Vázquez que fue el 12 de octubre del presente año, vio a Martín Miaguatl como a las diez de la noche y se iba cayendo de borracho hacia su casa; luego vio pasar a Miguel Vázquez y a su compañero Dionisio Luis, hacia la casa de Martín Miaguatl; y al poco rato, vio trayendo preso a Martín Miaguatl por haber dado muerte a Miguel Vázquez; y sabe que Martín Miaguatl es medio tonto y muy loco, si cometió el delito estaba muy borracho y no supo lo que hacía.
