Diego de Aguirre, vecino del pueblo de Jalapa, natural de la Villa de Durango, hijo legítimo de Miguel de Aguirre y de María de Duña, estando enfermo en cama en su entero juicio, otorga su testamento haciendo las mandas acostumbradas. Declara que algunas personas le tienen diferentes deudas. Tiene entre sus bienes la casa en que vive. Es casado con Isabel de Ochoa y al tiempo de contraer matrimonio, él sólo tenía un esclavo y la herramienta de su oficio y su mujer no trajo dote. Nombra como albacea a su mujer, al Alférez Laureano Fernández de Ulloa y a José Antonio de Acosta y como heredero nombra a su hijo.
